Earlier today I was doing an online test and was asked the question
“Contributory negligence arises as a result of the fault of which of the following?The claimant
The respondent
A third party”This was not on the OT website. I selected the the claimant as in the claimant had contributed towards their own situation and was told I was wrong and the answer was the respondent.
I accepted this as I thought the respondent was responsible for the initial fault (eg a faulty lock) and without this initial fault there could be no subsequent negligence.
Now I’m answering questions from the bpp textbook and the same question comes up. Ah-ha I won’t be fooled twice! This time I’m wrong again and the answer is the claimant.
I feel no matter how much I learn I keep getting contradictory or ambiguous questions that I am told I am answering incorrectly despite being familiar with the topic from the lectures or previous books. In short I’m losing patience with the ‘interpretive’ nature of this module. Has anyone else felt this way?
I’m hoping to get 85% on the exam so I can’t afford these silly mistakes but it seems no matter how much I cover I relearn something I’ve already been told but with a different answer.
Has anyone else had a similar experience? Just needed to vent that really 🙂
March 4, 2019 at 8:38 am #507361This is Q20 of ACCA’s CBE Specimen Exam and the correct answer is the claimant (Contributory negligence refers to the claimant’s own negligence in causing the loss
that he suffered).
I can only recommend that you use resources as published by ACCA and/or ACCA Approved publishers as these are quality assured.
Whenever questions are reproduced in some other software there is a potential risk that the correct answer is incorrectly flagged – which won’t be corrected unless it is pointed out.
The main advantage of using ACCA’s CBE Specimen, which is available here https://specimen.accaglobal.com/fls.html, is that you will become familiar with the software of the real exam.March 4, 2019 at 11:06 am #507387Thank you! That’s good to know.
March 4, 2019 at 12:19 pm #507397The first time you came across the question (where you selected ‘claimant’ and were told it was wrong) you said it was an online test
Which was the organisation that this test belonged to?
The second time you came across the question was in the ACCA CBE specimen exam and, as Kim so rightly says, the correct answer is ‘the claimant’
But I’d be interested to hear the source of the online test
March 4, 2019 at 5:33 pm #507500I’m not sure if you want me to link directly to the question as it’s on another accountancy (or is it cow? 😉 ) tuition website (not a patch on OpenTuition!).
I’ve just double checked and it definitely shows the correct answer is “The respondent” but it sounds like it was just a mistake. The site specifically mentions JUN 2019 SPECIMEN EXAM CBE Q20 Section A in the title.
Thanks for clearing up the confusion as my main issue I wasn’t sure what to choose if I face the same question in the real exam.
