Esme makes an offer under the UN Convention on Contracts for the International Sale of Goods to Mildred with the stipulation that acceptance should occur on 31 March at 12 noon. On 25 March, while Mildred is considering the offer, Esme tells her that it is no longer open to her.
Which of the following is an accurate statement of the situation at this point?
A Esme has made an effective withdrawal of the offer
BEsme has made an effective revocation of the offer
CMildred may still accept the offer on 31 March as it was irrevocable
DMildred may still accept the offer on 31 March but Esme may reject her acceptance
Esme has .made an effective revocation of the
offer isn’t this the case here since Esme took back his offer but answer is c can unplz explain howFebruary 7, 2022 at 3:01 pm #648236I don’t see ‘irrevocable’ in the question so my answer would be B effective revocation

March 5, 2022 at 8:29 am #649869Hello,
I am citing from Kaplan book, chapter 3 :
“An offer cannot be revoked if it indicates that it is irrevocable. It might state that it is irrevocable, or it might have a fixed time for acceptance, indicating that the person being made the offer may use that time to decide and the offer will not be revoked during that time. It is worth noting at this stage that this is different under English Law”.In this case Mildred was given a fixed time for acceptance, therefore the offer can be seen as irrevocable and can still be accepted by Mildred. I believe that is why option C is correct.
