Can you explain about case law, please?
  2. MikeLittleTutor
Surely this is covered in the lectures! Case Law is the element of English Law established on the basis of decisions of the Courts in determining the 'proper' or 'appropriate' resolutions in legal disputes. Case Law is the cornerstone of the principle of judicial precedent.

    Is that enough for you?
  3. Afroz
In my opinion it is Case Law The Law establish by Higher Courts after any unusual case Decision to become binding for the Lower Courts and used as Ratio Decidendi for such type of cases in future.
  4. MikeLittleTutor
Is this a response to the original post on this thread? The original post was 'Can you explain about case law, please?' Does your comment address that request? And what if a case never reaches beyond the High Court? How does your post fit that situation?

    Great Work Here
  6. MikeLittleTutor
    Thanks for your compliment
  7. Jan mahomed
i, can i used the note and course only to prepare for my exam.
  8. MikeLittleTutor
ALL the tutors will tell you that you MUST buy a revision kit and then, having bought it, you should then spend endless hours practicing the many many questions from within that kit.

And, when you come to an issue that you don't understand (as you surely will), then you must post on the Ask ACCA Tutor forum and I shall get back to you

    OK?
  9. Ashley
Thank you open tuition you are a life saver, I have attempted other skills level exams but have been avoiding this one because there is a lot of reading content
  10. MikeLittleTutor
Welcome to the Law paper. Take it easy and enjoy :-)

And when you hit a wall, post on the Ask ACCA Tutor thread and I shall get back to you

    OK?

  13. Barb
How can you get the last question wrong? How can Jude Law be a source of English Law?
  14. Beatrice
Hi Mike, thank you for this material, am looking to sit my exams in sept of this year and was wondering if I can use this material for my study guide even though have bought the BPP 1 Sept 2021 - 31 Aug 2022.

unto the quiz itself I got the last Q wrong and was wondering why that is the case because I am unsure why I did not get it right can you point me to which part in the chapter 1 I have to go back to again.
  15. Barb
Mike's no longer actively involved with OpenTuition so he's not likely going to reply ... so I'll reply instead

You got the last question wrong. What could possibly have led you to think that Jude Law was a major source of English Law?
  16. Swiss
The answer is Jude Law because whatever he says is the law
  17. liu
in the first question" what is not related to criminal law?" why the answer is plaintiff???
  18. liu
i've already got it ,my brain just shorted
  19. MikeLittleTutor
Glad to hear that it's reconnected :-)
  20. Marcia
Good questions. However, I've misinterpret the question about which part of a"court decision is binding on later similar cases and obviously my answer was incorrect!
  21. Asher
    Thanks for these helpful questions.
  22. MikeLittleTutor
Here's hoping that you'll find the rest of the site helpful right the way through your studies

Guys, we all need to get over ourselves and lose this entitled mentality.

This is free material that we are getting and if a mistake was made, then a mistake was made. How often has this happened?

And if you are smart enough to have followed the video lectures and a little bit of extra research on your part, you should have known better what the answer is.

Open tuition, we appreciate the content and we recognize that like any other humans, errors are made.

We are grateful and we will continue to support the program as our means allow.

No confidence lost at all on my part!!! And I know this is to many others who choose reason over pettiness.

    Thank you.

    Couldn't agree with you more.

I am loving this website and had a chuckle at the last question. Jude Law does sound like a type of law though and I can honestly say I did re-read the question - good job I've still got 6 weeks until my exam. Ha!

I'm so grateful for this extra resource and after watching the first chapter of the Law lectures I'm hooked. They are great - thanks so much. I know this website is going to prove invaluable to me in my ACCA journey.

Ive got question n0 2 wrong.. It was suppose to be corrected since January 2019 but nothing has been done up to now. This is very misleading and as someone mentioned people will lose confidence in your material
  26. MikeLittleTutor
Exactly how much confidence can you lose when the error has been clearly identified? Given that the site is free, that there are very few errors, that we all have other lives to lead and that there is a limited number of hours in a day that we can reasonably work, we have to prioritise.

For example, only Admin uploads material. The entire tax material needs to be re-written every year. Pretty well all the papers need an annual tweak. I'm fortunate in that the Law papers require little adjustment and the notes for the changes in the syllabus effective from September 2019 onwards are written and uploaded

A minor error in the quiz questions that is fully acknowledged in the forum should not (it really, really should not) cause you to question the quality of the material!

Even the "big boys" have faults in their material. Does that cause you to lose confidence in them?

Get over it and move on!
  27. Ansu Koroma
The correct answer for question 2 should be ratio decidendi and not ultra vires. I noted that I got it wrong after I finished the quiz. Please do mke the necessary adjustment for future attempt by student. Thanks
  28. MikeLittleTutor
As previous posts have indicated, the solution given is incorrect – but that’s easily seen when you open the thread to post your own complaint

It shouldn’t be a cause for major distress for you and, yes, it will be corrected

    OK?
  29. Ansu Koroma
    Thanks Mike

I am did this quiz today 10/05/2019 and the error in question 2 is still there. Looking at the thread of previous comments, it seems the complaint was first raised in December 2019. One wonders if it ever will be corrected, or if we can have confidence in the material presented here.
  31. MikeLittleTutor
Yes, you can have confidence in the material

As previous posts have indicated, the solution given is incorrect - but that's easily seen when you open the thread to post your own complaint

It shouldn't be a cause for major distress for you and, yes, it will be corrected

    OK?
  32. MikeLittleTutor
You say the complaint was first raised in December 2019 yet your post is itself dated in May 2019.

That's the first mistake that leads me into having a lack of confidence in your abilities

Your second mistake is that the error was first noted in September 2018 not even December 2018 - wrong month and wrong year - so now my confidence is totally shattered!

But I shall get over it and move on - I can make allowances for human error :-)
  33. wendiwoo
Answer 2 should be ratio decendi why has it marked that wrong. Can also only see answers up to Q4
  34. MikeLittleTutor
"Absolutely right – the correct answer is ratio decidendi and not ultra vires as indicated" (December 18, 2018)

"Did you read my previous post on this thread? The correction is in the pipe-line … it will happen in due course" (January 3, 2019)

"Have you read my posts from December 18 and January 3 on this thread?" (January 19, 2019)

Did you even THINK about reading previous posts before you decided to point out this error?
  35. bwatson
I think the correct answer should be ratio decidendi
  36. MikeLittleTutor
Have you read my posts from December 18 and January 3 on this thread?
  37. adriana8197
ultra vires had me thinking....I even searched it....I know the right answer is ratio decidendi....can the tutor confirm?
  38. MikeLittleTutor
Did you read my previous post on this thread? The correction is in the pipe-line ... it will happen in due course
  39. MikeLittleTutor
Absolutely right - the correct answer is ratio decidendi and not ultra vires as indicated

    Thanks for pointing this out
  40. batouray
If the answers are incorrectly set, this will either make people fail their exams or lose confidence on the practice questions set.
  41. jcas
Question 2 answer is ultra vires shouldnt this be ratio decidendi
    Please clarify
  42. adyeta18
    I to think so
  43. imadeiyamu
true, the answer ought to be ratio decidendi. Hope this gets fixed.
  44. Jasmine
Agreed, I was confused just now.
