Which of the following is a remedy available to the buyer under the UN Convention on Contracts for the International Sale of Goods, if not all the goods delivered by the seller conform to the contract?
1.To require correct performance by the seller
2.To declare the whole contract avoided
3. To declare the contract avoided in respect of the non-conforming
4.To reduce the price paid for all goods delivered under the contract
I believe 1 is the correct answer but can 2 and 3 not be the correct answers
It’s available for the aggrieved buyer to require correct performance.
If the seller fails to rectify the non-conformity by replacement or substitution, then the buyer would have the right to avoid or amend the price paid
