Hi Mike. Hope you are enjoying the bank holiday weekend. What do you mean by Statute should not create an offense of absolute liability ?
Bank holiday? It’s work, work, work – as usual!
Statute shall not create an offense of absolute liability? It means that we won’t / can’t pass a law that results in the possibility that there is NEVER a defence against being found guilty. There is ALWAYS a possible, viable, acceptable defence.
Statute says that people (ALL people!) in a car must wear a seatbelt whilst the car is in motion. BUT! There are valid excuses for not doing – short-stop delivery drivers, pregnant women and drivers when in the process of reversing.

You’re very welcome – and, just in case you are wondering, in the examples I gave in my last post, it’s any of those reasons that would potentially be a valid excuse. You don’t have to satisfy all three to escape the wrath of the law. Just one will do
