Sir what is the relationship between common law, civil law, equity law and criminal law. How are these interrelated to eachother.
September 16, 2022 at 8:26 pm #666566Criminal law relates to the subject of … crime. A person that commits a crime and is apprehended is taken to Court by a prosecutor (the police) and is tried in the Criminal Courts. If found guilty (not ‘liable’) s/he is punished by fine, imprisonment or both. A crime is an offence against society’s rules
Civil law relates to the situation where, for example, a person breaks a contract. In that case, the innocent aggrieved party will sue (not prosecute) the breacher and take their complaint to the Civil Court. If the breacher is found liable (not ‘guilty’) the defendant will be ordered to compensate the aggrieved party … where compensation is appropriate
Both Common Law and Equity Law are branches of Civil Law. Their distinction is fully explained in the course lectures that should be watched as, or shortly after, you read the course notes
