Sir can say if this statement is true or false
Bpp 13.13
An alteration must be bona fide for the benefit of all the company’s member
Answer
False
Explain why it is false
My initial reaction was to agree with you and think that the solution was incorrect. I even checked with the AI forum and Artificial Intelligence agreed with you and suggested that the correct answer should be ‘True’
However! I believe the question setter has demonstrated a bit of cunning in the precision of the words used. In law, an alteration may only be made if it is bona fide for the benefit of THE COMPANY AS A WHOLE.
The wishes of individual members are not taken into account. The individual hypothetical member of the future should be equally likely to benefit as be burdened by the alteration. The fact that a proposed alteration specifically targets, or adversely affects the interests of, an individual current member of the company does not automatically mean that it is unfair.
So, in summary, I believe that the correct answer to the question is ‘False’
OK?
