Which TWO of the following are AUTOMATICALLY unfair grounds for dismissing an employee?
(1) Engaging in trade union activity
(2) Constructive dismissal
(3) Dismissal on transfer of employment to a new undertaking
(4) Redundancy

B 2 and 3
C 3 and 4
D 1 and 3
why is the answer d? why not c?
constructive dismissal is also “unfair” right?
isnt number 2 and 3 the same thing?
Any answer HAS to include number 1 – employees have to be allowed to be members of a trade union
The question emphasises “automatically” unfair and constructive dismissal is not automatically unfair – it may be shown to be unfair or the company may show that, in the circumstances, it isn’t unfair
