Hi Mike, I don't really understand the measure of damages when a construction contract is breached. My kaplan text stated that "the cost of remedying the defects are disproportionate to the difference in value between what was supplied and what was ordered. ( please can you explain this in simple english)

13y ago#1The cost of draining and deepening and rebuilding a pool far outweighed the loss of amenity ( pleasure ) so damages were measured on the proportionate basis of the "missing volume" compared with contracted volume
