IF THE AWARD IS LEGALLY BINDING ( WHICH MEANS THE PARTY RECIEVING THE AWARD HAS WON THE CASE ) WHY WOULD THAT PARTY WHO RECIEVED THE AWARD SET IT ASIDE SINCE THE AWARD IS LEGALLY BINDING ( provided that they won the case)
Where are you quoting this from?
Chp 1( global law)
I meant which text book!
Bpp
Ah! I have to admit that I hadn’t recognised it as something that I had either written nor said in the lectures!
I suppose that one possible reason (the only possible reason?) would be that the two parties have since reconciled their differences and wish to continue a commercial relationship without any continuing acrimony
But, are you really sure that you have read / understood the BPP comment correctly?
There are limited grounds for appeal by the loser but only really on technical grounds
Hope this helps
Thank u so much sir
You’re welcome Safiya – I just hope that it helps
