Which TWO of the following are AUTOMATICALLY unfair grounds for dismissing an employee?
Engaging in trade union activity
Redundancy
Constructive dismissal
Dismissal on transfer of employment to a new undertaking
Dear Mike, it says that option 1 and 4 are correct. Why the option 3 is not correct? Does the Constructive dismissal not the unfair ground?
I put into search ‘is constructive dismissal automatically unfair’ and the answer came back as a categorical ‘YES’
I also put into a different search ‘Dismissal on transfer of employment to a new undertaking’ and got the response ‘Dismissals arising from a transfer of an undertaking are permissible provided they are done for economic, technical or organisational reasons.’
So the conclusion must be, reluctantly!, that the given solution is incorrect and the correct 2 choices should be 1 and 3
