The concept of precedence works on the basis that a later case is sufficiently similar to an earlier case that the judge in the later case must follow the earlier judgement
But when we’re talking about “similar” the similarity that we are concerned with is the similarity of the legal implications
We’re not concerned with the fact that the later case is almost identical with the earlier case with the exception of some of the peripheral detail
We ARE concerned with the legalities involved in the second case being sufficiently similar to the legalities of the first case … sufficient for the second judge to be obliged to follow the precedent established in the earlier judgement
Its very nice way of practice which gives feelings same as exam environment but if some few more question would be added it could be a strong exam preparation for this chapter.
