Yes these are the two main ethical issues – so to build it out into more marks you could comment on possible safeguards to reduce to an acceptable level. The published answer is far more comprehensive than any candidate would be expected to reproduce (with 8 marks for two suggestions, in the absence of any further split you can reasonably assume that 1. and 2. would each be worth just 4 marks).
