Please kindly explain me which one is the correct answer & which are wrong and why they are.
Under the UNCISG, goods do not have to comply with rules & regulations in the buyer’s state unless one of a numbers of exceptions applies.
Which of the following is NOT an exception to the rule ?
A). The same rules apply in the seller’s state.
B). The seller knew of the rules due to special circumstance.
C). The buyer told the seller of the rules & then relied on the seller’s expert knowledge.
D). There is evidence that the seller should have know about the rules when the contract was formed.March 21, 2021 at 9:33 pm #614932Hi

April 28, 2021 at 8:40 pm #619114the answer is D since if the other three exception applies then the seller has to sell good that comply with the rules and regulation in buyers state.
if you still have doubts it is explained in a very detailed manner in bpp study text – obligation of buyer and seller (UNCCISG)
May 4, 2021 at 9:57 am #619627Emphasis should be on the word “NOT” and exception.
A,B & C are exceptions i.e. circumstances where goods must comply with the rules and regulations in the buyer’s state.
Option D is the correct answer in that it is NOT an exception to the rule that goods do not have to comply with rules and regulations in the buyer’s state.
I hope this clarifies the position. Please listen to the lecture recording and review the Study Text for further clarity.
Best wishes,
Vijay
