1) The defendant must show that the claimant’s conduct contributed to the incident that caused the damage he suffered.
2) The defendant must show that the claimant’s conduct contributed to the damage which he suffered.
a) 1 only
b) 2 only
c) Both 1 and 2
d) Neither 1 or 2
And the answer is …?
And what do you not understand about the answer?
I’ve told you before, I’m not doing your homework for you
I shall explain answers from the texts that you don’t understand
OK?
The ask the tutor forum was not working and therefore the question got misposted without me asking the misconception that I had been having.
So the following is about the question:
What is the difference between contributing to the incident that caused the damage versus contributing to the damage suffered.
Contributing to the incident is where you and someone else together cause damage
Contributing to the damage is where someone, by their acts, causes you damage but then you make it worse by your own subsequent acts
OK?
