    Question: In relation to establishing a claim of negligence, which one of the following is Not correct?
    a) There must be sufficient proximity between the wrongdoer and the injured party.
    b) The standard of care required is that expected by the reasonable person.
    c) The same level of care is owed both to adults and children.
    d) The level of care to be shown varies with the level of seriousness of the likely consequences of breach of duty.

    In the above question, I think that option a) can be ruled out because proximity has to do with establishing whether a duty of care exists or not. But the other two points i.e. breach of that duty and resultant loss suffered don’t seem to be linked to the other options.

    Options b and d relate to the breach of the duty

    Option c is the incorrect statement – greater care should be taken when children are at risk

    OK?
