    This is actually a specimen question and I had an issue with this one. Could you please help me explain?

    Imran claims that Zak owes him £1,000 as a result of a breach of contract.

    In which court will Imran start his action against Zak?
    (1) The High Court
    (2) The county court
    (3) The magistrates’ court

    The correct answer is COUNTRY COURT. Could you please explain why?

    The correct answer is COUNTRY COURT

    There is absolutely no question that this would be decided in the Country Court It MOST CERTAINLY would NOT be decided in the COUNTRY COURT

    I assume you mean that the answer states ‘County Court’, the second option

    I would have expected an option of ‘the Small Claims Court’ but clearly it’s not a High Court case and it sounds too commercial to be a Magistrates Court case

    OK?

    I was thinking the magistrate court is the correct answer but I was wrong because the correct answer states that it is county court (could you explain why?)

    Since small claims are heard in the magistrate court < 5000 pounds BUT this question does not take that into the account. And I do not know why. Please explain why it is county court and not magistrate court?

    Types of civil case dealt with in the County Court include businesses trying to recover money they are owed

    Magistrates Court deals with (apparently) about 95% of all criminal cases! and this is where their work load is

    Magistrates are trained, unpaid members of their local community, who work part-time and deal with less serious criminal cases, such as minor theft, criminal damage, public disorder and motoring offences.

    If it’s a civil case, County Court will deal with it

    If it’s a criminal case, magistrates will deal with it (under indirect supervision)
