Sir,
1) Duty of care only arise where special relationship exist or does duty of care also arise where special relationship does not exist?
2) If a professional person advises a non client and he knows that non client will rely on his advice then in such a case
a) does special relationship exist?
b) does duty of care exist?
3) If a professional person advises a non client and he does not know that non client will rely on his advice then in such a case
a) does special relationship exist?
b) does duty of care exist?
1) duty of care always arises – for example, a motorist has a duty of care to all other road users
2) duty of care certainly does – but a professional person giving professional advice to a non-client? What planet are you from?
3) same comment as for 2)
