Hi!
I am having some difficulties to understand ‘rescission’ as a remedy.
Could you please explain?
Thanks.
Effectively, it’s turning the clock back in order to restore the parties to their original pre-contractual position
So where one of the parties discovers that they have entered into a contract following, say, a misrepresentation, they have the possibility of asking the court to turn that clock back and that would enable them (probably) to recover any money that they had invested
OK?
