And since the OBLIGATION for unidentified and specific are similar where does it ceases?
1)At Ex works (goods are made available for loading)
OR
2)At the point when goods are completely loaded and ready for transit.
OR are the both same thing?
I’m a bit confused?
I am asking in the context of obligation of seller in terms of delivery of both specified and unspecified goods
Hi Sourav,
Very simply the default position is that the obligation of the seller is discharged once the goods are placed at the buyer’s disposal.
Specific/Identified goods- If both parties at the time of forming the contract know that goods are going to be at a particular place then the seller’s obligation ceases the moment the goods are placed at the buyers disposal at that place.
Other instances- The seller’s obligation ceases when the goods are placed at the buyer’s disposal at the place where the seller had their business at the time the contract concluded.
Remember Incoterms may also have an impact on when the obligation ceases.
Kind regards,
Vijay
