I read on BPP text that the representation must be made by the principal or an agent acting on their behalf. It cannot be made by the agent who is claiming ostensible authority .
Sir, are these sentences not contradicting ?
Is it not better said that only the principal can make this representation to the third party?
Please, can you clarify me on this better ? Maybe I do not get it right but it seems confusing .
An agent, acting apparently on behalf of a principal, is able to make a representation
However, such a representation is not itself a contract (because a representation is a pre-contractual statement made of some known or discernible fact)
OK?
