Hi Tutor,
Are there remedies for wrongful dismissal and constructive dismissal? All I know is for unfair dismissal which is compensation, reinstatement, and re-engagement.
For wrongful dismissal, there are two situations … 1) a claim by the dismissed employee made through a tribunal and 2) a claim made through the Courts
In the situation of a tribunal hearing, the only real remedy is effectively In a tribunal the remedy would be a monetary award of compensation
In court the remedy would be damages and (rarely) an injunction
Constructive dismissals are invariably wrongful and thus the remedies are those outlined above
