Hi Stu,
Sorry to hear about the extra expense you incurred entering the exams this year. It sounds like your arguments are well reasoned to me.
One problem you may have is that In my bpp book, it states that “pure financial loss is rarely recoverable”. It sounds like pure financial loss is what you are thinking of claiming against here.
Also, even though anyone here can appreciate the personal importance that being able to apply for exams are to us, I wonder, by law, if you could argue that you have an absolute right to enter for an ACCA exam, and if not whether ACCA are then not liable for causing you suffering. I’m not sure about this point though, and I don’t think I’ve explained it very well.
I also wonder whether suing ACCA would be a great idea. Could they turn round and say “we don’t want any association with Stu anymore”? If that was possible, then even if you win the case, you’d be a lot worse off.
