For a precedent to be applied , decision must be form part of the ratio dicendi . What does ratio dicendi means?
Also, in teleological method , what does the Judge mean by social purpose of the legislature? Sorry I do not based in Uk and I am doing global F4
Ratio decidendi literally means “the reason for the decision”
It’s the fundamental reasoning behind the Court’s decision
I have never heard of teleological as a part of F4!
By “social purpose” is meant the resulting effect on society as a result of implementing / interpreting statute
