I want to ask as I have a confusion.
If the method of communication is not specified by the offeror and he offers through a better method of communication compared to post. In return, offeree sent acceptance through post. Will postal rule apply here?
Hi Isabella
I’m sorry – I missed this post when I answered your other question.
For postal rule to apply, both parties must have thought that the postal method was appropriate. In this case, if the offeror uses a swifter method than by post, that would seem to suggest that the offeror does NOT consider the postal medium to be appropriate.
If that is the case, the postal rule would not apply.
The acceptance would still be potentially valid but, if in fact the postal rule does not apply, any other offeree that accepts other than by post, even though their acceptance may be later than the date of the posting acceptance, would gain priority over the postal acceptance
I hope that that makes sense 🙂
Don’t be sorry. Tutor like you are very limited.
