An OpenTuition mock question about Thanasis selling 2 copies of an Anderson print asks whether a latter posted before the deadline but received after the deadline means that the poster of the letter accepting the offer won’t be able to successfully claim an Anderson print is a true statement.
Why is this? The postal rule says that with reference to acceptance of an offer, an acceptance is effective from the moment it is put into the postal system.
August 22, 2017 at 8:03 am #402874That is certainly the ‘normal’ rule
However, do I remember correctly that, in the Thanasis question, he posted the acceptance because he was unable to attend in person to communicate acceptance
One of the pre-conditions for the postal rule to apply is that the post should be considered by both parties to be an acceptable medium
When you’re standing in an art shop and thinking about buying a print, is it the case that you were thinking “If I am going to accept the offer, I will probably do it by posting a letter”?
Is the dealer saying to herself “This person is most likely to go away and then post a letter by way of acceptance”?
4 conditions for the postal rule to apply:
1 properly stamped
2 properly addressed
3 put into the postal system through the proper channels
4 both parties must have thought that acceptance by post was an appropriate mediumOK?
