Model Law on International Commercial Arbitration
Under Article 1(3) arbitration is international if:• the parties to the arbitration have their places of business in different states at the time of conclusion of the arbitration agreement
• or one of the following places is situated outside the State in which the parties have their place of business:
– the place of arbitration if determined, in or pursuant to, the arbitration agreement
– or the place where a substantial part of the obligations of the commercial relationship from which the dispute arises is in a different state from where the parties have their business
– or the parties have expressly agreed that the subject matter of the arbitration agreement relates to more than one country.
I don’t understand the above points. Please explain in simple words
These points are from Kaplan book.
October 27, 2023 at 7:39 pm #694071On reading and re-reading numerous times to try to make sense of the question … it seems to me that you haven’t faithfully reproduced the question fully. There seems to be one or two words missing.
May I ask you to review your post and import any / all of those missing words?

I have one more question. In the initial chapter, There are a lot of topics in the Kaplan law global book that are part of the English version. Will it be okay to watch both English and Global version lectures for exam preparation?
October 31, 2023 at 6:59 pm #694263Well, there’s no harm in reading both versions – but only insofar as they genuinely do coincide.
But I have a question! If there is duplication, why not simply watch the lectures and then watch them again. Either Global or English – if the topics are duplicated, why watch both sets of lectures.
You’ve opted for the Global variant so stick with that.

November 1, 2023 at 12:17 pm #694277The first three chapters (lectures) of English system are part of global variant syllabus and are covered in Kaplan study text but it’s very difficult to understand from the explanation given in the Kaplan book.
Those topics are covered in the English variant lectures but not in global variant lectures.

3) please explain the following statement “‘CISG will apply where the private international law rules appoint the law of a CISG state in a case of international sales.”

The United Nations Convention on Contracts for the International Sale of Goods (UNCISG) is an agreement that has been formalised into a set of rules that seek to eliminate the disputes that may arise as to which party is in the right when an international sale of goods doesn’t proceed through to the end that both parties had envisaged
2) Please explain the “Business place rules” of UNCCISG? The applicability of the UN Convention is determined primarily by the place of business of the seller. If the place of business of the BUYER is in a different state than the place of business of the seller, then UNCISG will likely apply. But if the place of business of the buyer is in the same state as the place of business of the seller, then the domestic rules / laws of that state will apply
3) please explain the following statement “‘CISG will apply where the private international law rules appoint the law of a CISG state in a case of international sales.” Where, in an international sale of goods contract it is stated that English law shall apply to the contract, then English law shall apply to that contract. But where the contract for an international sale of goods does not specify that the domestic law of either of the two contracting parties’ countries shall apply, then CISG shall apply
4) What is Private international law and public international law? And the difference between them? A potentially long answer! Check out this link and come back to me if you still have doubts!

I’m enrolled in a bachelors course, BBA international finance accredited by ACCA. My university allows 9 papers exemption and CBL global is one of them. Once I complete my degree, I only need to sit for Professional level papers with ACCA.
As for my CBL exams with university, my semester 3 exams (includes CBL) starts from February next year.

Good luck next year but, in the mean time, do post your questions about ANY of the ACCA papers that you need for your 9 exemptions and, I guarantee, you will get a response to help with your studies promptly.
