Hello mike!
I wanted to know if I can use opentution notes without lectures to revise the syllabus for F4(eng) CBE.I have already studied bpp study text but now I want to revise the course so is it enough if I use the notes only?

If you look you’ll see that the notes are very much page after page of bullet points and the lectures fill those out
Sorry – you may get away with it … dependent upon your appreciation of the study text

I have 2 questions so far:
1- What is the difference b/w appeal by a court and appeal by way of case stated?
2-Can you explain the section 39 of companies act 2006(concerning ultra vires contracts)?
It is stated as: “the validity of an act done by a company shall not be called into question on ground of lack of capacity by the reason of anything in the company’s constitution”(cannot understand it from ‘ground of lack of…companies constitution’)October 26, 2016 at 3:31 pm #3461282 – this means that even though the entity’s constitution may not allow the transaction, the transaction is nevertheless valid against the entity and a third party acting in good faith can always enforce a contract against an entity
1 – I would need the context because I’m not happy with the expression “appeal by a court”
Appeal by way of case stated is where a court or tribunal asks another court for their opinion
October 26, 2016 at 4:06 pm #346139In Bpp study text(page no.7),there is a diagram for Civil court structure.It represents that High court can hear both ‘Appeal’ and ‘Appeal by way of case stated’ from magistrates’ courts.

As stated in my previous post, case stated is where a tribunal or other court applies to the court for their opinion
