Sir in thanasis case, am I right by saying that if damages would have been ordered then it would have been insufficient/inadequate (as the print was rare) and therefore specific performance was ordered?
Damages would never come into it … the Court would look and ask itself “Would damages be a sufficient remedy? No! Therefore we’ll revert to an equitable remedy of specific performance”
