Explain the application of Huut gaat voor koop rule in a lease agreement.
For those not familiar with the language, it’s Dutch!
The expression relates to the priority of rights in the situation of a lease agreement. If, before the lease agreement is finalised, the leased property is sold to a third party, the question is ‘Does the lessee maintain their rights of leasing as set out in the as-yet un-finalised lease agreement.’?
And the answer is … No!
