In relation to the UNCCISG, which of the following statements are correct?
The buyer may declare the contract avoided if:
1- the seller commits a minor breach of contract
2- the seller hasn’t delivered the goods
Why is the answer neither 1 & 2? Isn’t failure to deliver and breach of contract resulting in declaring it avoided?
Hi Ketki,
In order to avoid the contract there must be a breach of condition ie a fundamental term and not imply a minor breach.
