November 12, 2016 at 4:13 pm #348618Actually, I have one more question. Its the 1st mtq in the specimen cbe. Az ltd were building a ship for Bob for 7 million. He decided not to buy it. Az ltd had already spent 5 million on the ship and immediately started an action on Bob. However, a week before the case decision Az sold it for the amount of money they would have gotten from Bob. What level of damages can Az claim for breach of contract.

There is a duty to mitigate the loss where a party is potentially going to suffer from a breach of contract
Here AZ has mitigated so there is no loss
