can anyone plz tell me what is long- term occupation ?
‘ the accommodation is actually let for at least 105 days a year . (excluding periods of long term occupation).
– where a tax payer owns more than one property, the 105 days test is satisfied if the average number of days for which the properties are let in the year is at least 105.
August 3, 2015 at 7:20 am #264871Long term lettings are generally lets of more than 31 consecutive days.If due to unforeseen circumstances a let lasts longer than 31 days this will not be counted.For example, due to illness or flight delay.
August 3, 2015 at 7:35 am #264885In terms of second part of your statement if an averaging election is made then a property may qualify as being a furnished holiday letting despite not meeting the 105 day rule.
For example, if a taxpayer owned the following furnished holiday lettings and made am averaging election
Cottage A let 110 days
Cottage B let 105 days
Cottage C let 100 days
Considered on its own cottage C would not qualify as furnished holiday letting.However, the average number of days let of all taxpayers furnished holiday lettings is 105 days and so it is deemed a holiday home letting.
