Hi,
My problem is the following.
I pass all the exams and my current employer who is qualified signed 9 the Performance objectives.
I technically completed the 36 months of experience however, my former employer refuse to sign my time. The consequence is that I am losing 1.5 year and that I won’t be able to apply for membership before December next year.
Do any of you know if I can do anything in this regard?
I think I should look for legal advice at that point however, I am not sure what kind of lawyer I need.
I also would like to know if this situation already happened (highly probable) and where should I look for the justice decision if it went to court.

If you are unable to get your time in a relevant role approved then I regret to advise you that it cannot be counted towards the 36 month requirement.
October 17, 2018 at 9:32 pm #478992I would be interested to know what would happen if someone in this situation were to report the member who refuses to sign off on the time to ACCA for breach of the bylaws in particular:
Section 110: Integrity – The principle of integrity imposes an obligation on all professional accountants to be straightforward and honest in all professional and business relationships. Integrity also implies fair dealing and truthfulness.
Section 150: Professional behaviour – The principle of professional behavior imposes an obligation on all professional accountants to comply with relevant laws and regulations and avoid any conduct that the professional accountant knows or should know may discredit the profession. This includes conduct that a reasonable and informed third party, weighing all the specific facts and circumstances available to the professional accountant at that time, would be likely to conclude adversely affects the good reputation of the profession.
I challenge someone to test the waters.

January 29, 2023 at 6:36 am #677540Hi have you solved this issue? I’m experiencing similar situation.
Former employer who is a qualified accountant said he is unsure whether he can help me to sign since I no longer work in the same company. Though there’s no written agreement that the employer must sign, but isn’t it basic human decency to help other fellow human being? It doesn’t cost him or his firm money or reputation anyway.
I’m very disappointed with the fact that this issue has to be delayed for over a month with no result despite signing off being a simple short process.

See the section “Leaving your role”. You should have asked your former employer to sign at that time.
You don’t say how long it is since you changed role – if a while ago, you could see if you can complete the process and apologise that you didn’t do this at the time before asking ACCA directly for advice, if still no success.
