Ok but this concept does not apply on Bonus issue and underwriting na?
Bonus issues? These are ALWAYS issued and accounted for at nominal value
Underwriting? Nothing at all to do with issuing shares at a discount!
OK?
Sir just the last question
If any such scenario of bank and claimant comes in exam , where claimant has asked the opinion/advice of bank and while giving statement in professional context bank has given exclusion clause (disclaimer) also but bank knows that claimant will rely on such statement given and claimant also actually relied then in such a case if statement proves to be misleading then
1) Bank would NOT be liable na?
2) Won’t such exclusion clause be deemed to be void under UCTA 1977?
Correct
