1) IF the purchaser had stated that it was really important that he should own a 1942 model motor bike then, in that situation, would he be able to sue for misrepresentation ( damages and/or rescission)?
2) Sir but we consider that sufficient proximity or relation exist (i,e neighbor) na? In earlier cases we have not stated that the claimant should have close ties of love and affection with the person who suffers injury or death
