    Yes, but that’s at the company’s discretion

    He has no automatic inherent right which is what your question suggested

    He could also be repaid his capital if the company went into a solvent liquidation …

    … but that liquidation step is not Ho’s choice

    In answer to the implicit question in your original post, no, he has no right of access to recover the premium paid on the acquisition of those shares
