Could you please explain what is:
1. Appeal by the was of case stated?
2. Appeal on a point of law?
3. Leapfrog procedure?Many Thanks 🙂
November 15, 2015 at 2:52 pm #282556Case stated – it’s an appeal procedure to a higher court where the junior court has heard a case and wants a more authoritative opinion. It may also be where, for example, it’s a case brought before magistrates in a magistrates court but the sentence that the magistrate feels would be justified lies beyond the magistrate’s powers
Where a case has been heard but the loser has been given right to appeal to, say, the Supreme Court because the Appeal Court is uncertain about the law, the law is vague or maybe needs updating
Leapfrog is where a case is heard in High Court and the loser wishes to appeal. But if the High Court decision is based on a precedent set in Appeal Court, there’s no point in appealing to the Appeal Court because they too will be bound by that previous decision. So the loser is given permission to leapfrog over the Appeal Court and take the appeal straight to the Supreme Court
