That causation question was not a fair question! I looked all all my notes, no one mentions it anywhere……..not even once was that term used anywhere.

Sangria9, I think u may be wrong, since investing later has an effect on the sharing ration, i hope the new sharing ration would be 50:30:10 and the (9000 – 5000) = 4000 must be distributed as a loss between them at sharing ration. All partners are fully liable under PA 1980 remember this

It was a loan of £1000 not additional investment … so I think this has to be repaid before any losses/profits are paid back according to the original Profit Sharing Ratio

I consider this loan as usual loan, not additional investment. Business always takes and repays loans. And I think this loan should be treated same as other debt of the company.

I found the exam okay in most areas. Uk variant. Funny enough I was using a 2011 book to study as I had it previously. Clearly didn’t know anything about addition of the bribery act and so due to open tuition notes I crammed the info into my head right before the exam. I hopefully got good marks on that one.

Unfortunately I answered negligence causation as “remoteness of damage”. Even quoting the case nearly word for word and realised outside the exam I answered the wrong thing haha. Fingers crossed.
