June 7, 2011 at 1:07 pm #83297I remember I was busy writing ….and I heard the voice saying …1hr left….but in moment can not comment on the exam……!!..if ask was it fair….yes I can say that…!!..exam came in a way p’ple did not expect,put concentration in some difficult topics and we ignored these little things….that it came……!!..anyway..I remember I wrote something….
June 7, 2011 at 1:11 pm #83298the moment i strtd readin the questions, i was Thanking God for having got questions tht seem to be familar with wht i studied, i was glad to have written somethin in my answer sheet, if not a proper answer at least a bits n piece answer. The paper was ok (GLO variant), but had i done a more systematic study, i wud have given tht paper “excellent”

I think it wasn’t so bad but who knows? The last time I was proud of myself and achieved the worst result.
I forgot what was wrongful dismissal.

I was also relieved to see a bunch of family topics, but when it came down to really writing them out I drew a lot of blanks! This was my first written exam (only CBEs before) so it was an adjustment. That’s a lot of writing in 3 hours, and I have a hard time without some scratch paper to draw up outlines or rough drafts. I did lots of scratching out. We’ll see! Good luck everyone!

guys, could anyone advise about the correct answer for question 10:
what was the proper order of debt repayments on liquidation? should the overdraft with persnal guarantee be the last in the sequence?

June 7, 2011 at 3:50 pm #83311i wasnt aware that the overdraft had a personal guarantee.. the personal guarantee was for any shortfall for the fixed charge (which it appeared there would not be). I think that they will end up about GBP 5k short in the end but its a limited liability company and the members are therefore not responsible for this shortfall.
The order:
Fixed charge – 20k loan secured by 20k property. Realised value goes to chargeholder and the shortfall is paid by guarantor.
Liquidator expenses – worth mentioning
Preferential debts – not applicable
Floating charge – not applicable
Deferred debt – not applicable
Unsecured Debt – Bank loan GBP 10k, trade cred 10k
Nominal value (none – in fact sh need to contribute GBP 7500)
Surplus (none: note 1)note 1 – GBP 7500 assets + GBP 7500 cash from payment = 15k. Need to pay 20k in unsecured debt. 5k shortfall loss to unsecured creditholders.

but I thought question said that all debt owed to the bank is guaranteed, therefore assumed that all overdraft should be covered by the owner, wheras trade payables will be covered by company’s assets (7,750) + unpaid share capital (2,250). Ultimately everything is paid…

so 1000 x 75p = £750 each so £2250
The other assets were given as £7750
so after the fixed charge/land was dealt with there was £10k left for creditorsJune 7, 2011 at 4:00 pm #83316Anyway this is a Law exam. There are not marks going for getting figures correct but for stating and apply laws.
But it was a very reasonable paper and I will be disapointed if I havent passed.
