Question: Which of the following statements regarding the apex court is correct?
a) It is bound by its previous decisions, but it may depart if they are considered to be wrong.
b) It is always bound by its previous decisions
c) It is normally bound by its previous decisions, but may depart when it appears right to do so.
Regarding the above question, I think all three options are incorrect because the apex court is not bound by its previous decisions, the high court is. So are all three options incorrect.
Option a) is the correct answer. The Supreme Court generally accepts that it’s previous decisions are binding but, in extreme and very rare cases, the Supreme Court will allow itself to be not bound by those earlier decisions
