Question: What does persuasive precedent mean.
Which courts’ decisions are persuasive precedents.
A persuasive precedent is, for example, a precedent established in a case from the High Court and that precedent is now relevant to a case in a superior court
The High Court precedent is not binding on the Court of Appeal but the C of A may take the High Court’s decision as persuasive … but not binding
