Hi,
I’m doing questions from the BPP revision kit and I’m confused with contradicting statements regarding offer of alternative employment. “Question 11.3 in Employment Law” states the below
An employer may choose to offer a redundant employee alternative employment. If the employee unreasonably refuses the offer, they lose their entitlement to a redundancy payment. Broadly speaking, the alternative employment must be in the same capacity, at the same place and on the same terms and conditions as the old employment. It should not be perceived as being lower in status.
Then the next question is
“If Grace does not accept an offer of alternative employment, which of the following statements is correct?”
To which I thought she would not be entitled to any financial compensation but the answer is that is she entitled to three weeks as she has been employed for three years.
Are you able to clarify what the rules are regarding redundancy pay and declining an offer of alternative employment please?

If Grace has been offered alternative employment “in the same capacity, at the same place and on the same terms and conditions as the old” and she has turned this down, then she should not be entitled to compensation.
If the alternative employment offer was NOT in the same capacity, at the same place and on the same terms and conditions as the old employment, then she should be entitled to compensation.
Is that ok for you?
