Greetings Sir, I hope you are doing good,
Please help me confirm the answer of this statement from MTQWe need to identify if this factor indicates that Fred is employed or self employed
‘Fred is also paid gross, however for ease of adminstration he submits a monthly timesheet and is paid via the payroll system’
So the answer given behind says, employee. But I think Fred is selfemployed as there have been no tax deductions
What do you think sir??
November 27, 2019 at 9:18 am #553878Being paid gross without deduction of tax is just one of many factors taken into consideration when determining employed / self-employed status
Submission of timesheets and payment through the payroll system are two other factors
As also are entitlement to paid holidays, supply and use of tools and equipment, ability to choose which tasks to accept, responsibility for quality of work performed, application of national insurance deduction rules, ability to sub-contract work delegated to Fred …
The decision as to whether a person is an employee or is self-employed is a matter of weighing the positive indicators against the negative indicators … not always an easy task!
OK?
