When does a summary dismissal occur?
a) The parties agree to end the contract immediately
b) The employer terminates the contract with notice but no investigation
c) The employer terminates the contract without notice
Regarding the above question, summary dismissal occurs when there is a serious breach of contract of employment, so where does this definition fit with the above three
options. None of the above mention serious breach of contract.
When the employer terminates the employee’s employment without giving notice
Typically where the employee has committed a serious breach of contract, but the serious breach of contract element is used as an example
An employee could be summarily dismissed without notice for reasons other than a serious breach of contract
For example, if you walked into work and, with no justification (could there ever be justification?), told your employer to “F*** O**”
