Which of the following statements is Not true about wrongful dismissal?
a) It is a breach of contract
b) It can be heard in both civil courts and employment tribunals
c) It is a statutory right
d) Liability is limited to the net pay for the maximum contractual-statutory notice period.
In the above question, I don’t understand the meaning of option d). What is option d) taking about. Also if both wrongful and unfair dismissals are breaches of contract then what really is the difference between two. What is that key thing that differentiates between wrongful and unfair dismissal. Also wrongful and unfair dismissals are illegal and therefore they are statuary rights
“unfair” is a breach of statutory rights
“wrongful” is a breach of contractual rights
What is there not to understand? It’s saying that compensation is based on length of service
And that’s wrong
