Hello
While establishing that duty of care exist or not, which test we have to consider? Neighbor principle or Three stage test? Or both?
November 26, 2017 at 10:55 pm #418186Both! But neighborhood test is one of the 3 part test – it’s just called by a different name
November 27, 2017 at 2:48 pm #418435Sir how is the neighbor principle one of the 3 part test?
November 28, 2017 at 1:20 am #418501Is a duty of care owed? And to whom do you owe this duty of care?
November 28, 2017 at 7:35 am #418531Sir , 3 part test is as follows na
a) sufficient proximity or relation exist
b) loss is foreseeable
c) it is fair and reasonable to impose a duty of careSir here, where is the neighbor principle applied?
November 28, 2017 at 8:07 am #418538What do you think “a) sufficient proximity or relation exists” means?
!!!!!!
November 30, 2017 at 4:08 pm #419235I think you mean to say that sufficient proximity or relation or in other words neighbor principal means the same thing.
November 30, 2017 at 4:13 pm #419238Who are the people that live in the premises proximate to your home?
Are they not your neighbours?
