    Hello

    I am have done the December 2014 (English Variant) F4 Past Exam Paper from the ACCA website.

    I got a different answer to Question 44.

    Question 44: Which of the following correctly applies to the burden of proof in a criminal case?

    Options:

    A) It must be proved beyond reasonable doubt.

    B) It must be proved on the balance of probabilities.

    C) It lies with the prosecution

    D) It lies with the defence

    Actual Answer has stated in the December 2014 Answers:

    C) It lies with the prosecution

    I, personally thought the Answer was A) It must be proved beyond reasonable doubt.

    It says this in all of the notes from all of the Tuition providers.

    How can the answer be C), surely it’s A).

    Can someone please assist me with this query.

    It’s up to the prosecution to prove beyond reasonable doubt that the accused is guilty

    “It’s up to the prosecution to prove …”

    The responsibility lies with the prosecution to show …

    The burden of proving beyond reasonable doubt is on the prosecution … it’s their burden, their responsibility

    What does the prosecution have to prove whilst carrying out their burden? They must show beyond reasonable doubt that the accused is guilty
