I came across this question from the course notes from chapter 6 (GLO)
Which of the four options is incorrect? “In the context of the UN Convention for the International Sale of Goods, where a contract involves carriage of the goods, there is no obligation on the seller to ensure that the goods comply with legislation in the buyer’s state unless …..”
A the same legislation applies in the buyer’s state
B the buyer made the seller aware of the legislation
C the seller knew the requirements of the local legislation
D the buyer reasonably expected the seller to be aware
According to me the answer is A and D, since the same legislation should apply in the sellers state and not in buyers state and the the buyer cant expect the seller to to be aware as it is the buyers duty to inform him.
But the answer is given as D.
Awaiting your reply
“….to ensure that the goods comply with legislation in the buyer’s state unless the same legislation applies in the buyer’s state”
That completes the sentence using option A as the final part of the sentence.
Now, ask yourself, “Does that make sense?”
Yes, but in that case the seller won’t be obligated to comply with the legislation of the buyer’s state as the seller might not be aware about it. The only way that the seller would be obligated if the same legislation was in his state as well or was informed by the buyer.
(I might be wrong)
I may need to think about making that option A clearer.
I think that it would be clearer if I had “the legislation in the buyer’s state was the same as that in the seller’s state”
You’ll probably agree
