Sir,
(1) If timing of payment is not specified within contract then payment will be initiated only after”receipt of all goods, relevant documents and after examining the goods
(2)If carriage is involved then goods shall not be released until payment is done
Aren’t the above statements counterintutive
How to release goods since payment isn’t made and how to make payment since goods aren’t received thus not examined
Hi Sourav,
(1) Applies to contracts where “Carriage” is not involved ie where the goods do NOT involve transportation to a “carrier” for transmission to the buyer. So for example Seller delivers goods directly to buyer.
Wheras para (2) applies to contracts that involve “carriage” i.e. a contract where the goods have to be transported to the buyer as part of the contract.
I hope this clarifies the difference.
